2. These terms
These terms apply to all orders placed on our website and to your use of the website. Please read them before ordering. Our Returns & Refund Policy, Shipping Policy and Privacy Policy also apply.
Some parts of these terms apply differently depending on whether you are a consumer (an individual buying mainly for purposes outside your trade or business) or a business customer (for example a salon or self-employed nail technician buying for your business). Where this matters we say so.
3. Placing an order
When you place an order you are offering to buy the products. We will email you to confirm we have received your order, but the contract between us is only formed when we email you to confirm your order has been dispatched. We may decline an order, for example if a product is out of stock, we cannot deliver to your address or there is a pricing error. If we decline an order after taking payment, we will refund you in full promptly.
You must be 18 or over to place an order.
4. Our products
We try to show products accurately, but colours may look slightly different on your screen, and packaging may vary from the images shown. Many of our products are intended for professional use. Always read the label, ingredient and safety information and follow the instructions, and carry out a patch test before use. Stop using a product and seek advice if you have a reaction.
5. Pre-orders
Pre-order products show an estimated dispatch date, which depends on our suppliers and may change. We will keep you updated if it does. You can cancel a pre-order at any time before dispatch for a full refund.
6. Prices and payment
Prices on our website are in pounds sterling and include VAT. Delivery charges are shown at checkout before you pay. The price you pay is the price shown when you place your order.
If we discover an obvious pricing error (a price that is clearly and unmistakably wrong), we will contact you before dispatching your order. You can then choose to go ahead at the correct price or cancel for a full refund.
Payment is taken when you place your order. We accept the payment methods shown at checkout.
7. Delivery
We deliver to UK addresses only. See our Shipping Policy for delivery times and costs. Unless we agree otherwise, we will deliver within 30 days of the contract being formed. The products are our responsibility until they are delivered to you or to a person or place you have nominated. You own the products once we have received payment in full.
8. Your right to cancel (consumers)
If you are a consumer you can cancel your order within 14 days of receiving the goods, subject to some exceptions. Full details, including how to cancel and the model cancellation form, are in our Returns & Refund Policy.
9. If there is a problem with your products (consumers)
We are under a legal duty to supply products that are of satisfactory quality, fit for purpose and as described. Nothing in these terms affects your legal rights under the Consumer Rights Act 2015. In summary: if your product is faulty you may reject it for a full refund within 30 days; after that you can ask for a repair or replacement, and if that is not possible or does not fix the fault, a refund or price reduction. 10. Our responsibility for loss or damage (consumers)
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the products, and for defective products under the Consumer Protection Act 1987.
We only supply products for domestic and private use as a consumer. If you are buying as a consumer, we are not responsible for any loss of profit, loss of business, business interruption or loss of business opportunity.
11. Business customers
If you are a business customer, this section applies instead of sections 8 to 10:
- We warrant that on delivery the products will be of satisfactory quality and will correspond with their description. If products are faulty, please tell us within a reasonable time of discovering the fault and we will, at our option, repair, replace or refund them.
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.
- Subject to that, we will not be liable for any loss of profit, loss of business, loss of goodwill or any indirect or consequential loss, and our total liability to you in relation to an order is limited to the price paid for that order.
12. Events outside our control
We are not responsible for delays caused by events outside our control (for example extreme weather, strikes, carrier disruption or supplier failures). If this happens we will contact you as soon as possible and take steps to minimise the delay. If there is a risk of substantial delay, you may cancel your order and receive a refund for any products you have paid for but not received.
13. Using our website
The content on our website, including text, images, logos and designs, belongs to us or our licensors. You may use it for your own personal, non-commercial use but must not copy, reproduce or republish it without our permission. You must not use our website for any unlawful purpose, attempt to interfere with its security or operation, or use automated tools (such as scrapers or bots) to access it without our permission.
If you submit a review or other content, you give us a non-exclusive, royalty-free licence to use and display it on our website and social media. You confirm the content is your own honest opinion and does not break any law. We may remove content that is unlawful, offensive or breaches these terms.
Our store is hosted on Shopify. Your contract for any purchase is with Andromeda Nail Supply LTD, not Shopify.
14. Your personal information
We use your personal information as set out in our Privacy Policy.
15. Changes to these terms
We may update these terms from time to time. The terms that apply to your order are the ones on our website when you placed it. Changes will not affect orders already placed.
16. Other important terms
We may transfer our rights and obligations under these terms to another organisation; we will tell you if this happens and it will not affect your rights. You may only transfer your rights to another person with our written agreement. Nobody else has any rights under these terms. If a court finds part of these terms unlawful, the rest will continue in force. If we do not insist straight away that you do something you are required to do, that does not stop us doing so later.

These terms are governed by the law of England and Wales. If you are a consumer, you can bring legal proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of Scotland or Northern Ireland. If you are a business customer, the courts of England and Wales have exclusive jurisdiction.
